Terms of Use
Draft, pending legal review
This page is a working draft. It is not final and is not yet legally reviewed.
1. About these terms
These terms apply when you use the Solar Split website, app or Home Kit ("Solar Split"). Solar Split is operated from Brisbane, Queensland, Australia. Contact: support@solar-split.com.
By creating an account or subscribing, you agree to these terms. Joining the Home Kit waitlist is covered in clause 7. You must be 18 or over.
2. What Solar Split is (and is not)
Solar Split is a calculator. It reads energy data from your meters, inverters and batteries and shows a fair split of electricity costs between homes on a shared connection.
| Solar Split is | Solar Split is not |
|---|---|
| A calculation and reporting tool | An electricity retailer or energy seller |
| A source of usage allocation statements | A tax invoice or a bill |
| Read-only: it looks at your equipment and does not control it | A payment service. We do not hold, collect or move money between you and anyone else |
| Information you can use to have a fair conversation | Legal, tax, accounting, financial or metering advice |
3. Your responsibilities as the host
The person who holds the electricity account (the host) stays responsible for:
- following the energy laws that apply to sharing or on-selling electricity in your state, including any retailer exemption or registration and any limit on what can be charged;
- following tenancy and rooming laws, and what your agreement with occupants says about utility charges;
- deciding what, if anything, to charge anyone, and checking our figures first;
- telling other people on your site that their information is used, and letting them see this policy.
Solar Split does not check that your arrangement is lawful. Rules differ between states. If unsure, get advice from a lawyer or the relevant regulator.
4. Meters and supported hardware
Solar Split needs energy data from equipment that we support. The current list is on our website and may change.
Readings from the equipment we support are information-grade. They are not billing-approved or revenue-grade metering. Results are only as good as the readings we receive, which can be missing, delayed or wrong. Each statement shows how complete the data was.
If your equipment is not supported, or a vendor stops giving us access, Solar Split may not work for your site.
5. Subscription and payment
Subscriptions are not open yet: billing has not started and the price below is the planned price. This clause applies from the day we start billing, and we will tell you before then.
| Item | Detail |
|---|---|
| Price | A$8.00 per month per site, GST inclusive |
| Billing | Monthly in advance, by card only, through Stripe. We never see your full card number |
| Auto-renewal | Your subscription renews every month until you cancel |
| Other people on your site | Read-only access for other people on a site is included |
| Failed payment | We or Stripe will retry the card over about three weeks and email you. If every retry fails we cancel the subscription |
| Price changes | We will email you at least 30 days before any price increase. You may cancel before it takes effect |
The renewal date is shown in your customer portal and in the emails Stripe sends you.
6. Cancelling and refunds
You can cancel any time from the customer portal (link in your account and in Stripe emails) or by emailing support@solar-split.com. There is no cancellation fee and no lock-in.
Cancellation takes effect at the end of the period you have paid for. You keep access until then. We do not give partial-month refunds for change of mind.
Nothing here limits your rights under the Australian Consumer Law. If the service has a major problem, is not as described, or fails a consumer guarantee, you may be entitled to a remedy, including a refund for the affected period. Contact us and we will sort it out fairly.
7. Home Kit (hardware) and the waitlist
The Home Kit is a Raspberry Pi hub, set up to send readings to Solar Split. It does not include meters. At least one home needs a supported consumption meter, and your own licensed electrician installs it. We do not install meters.
The Home Kit is not on sale yet. You cannot buy one today. You can join the waitlist so that we can email you if kits become available. Joining the waitlist is not a purchase and not an order, and no payment is taken. It creates no obligation for you to buy anything, and it does not commit us to sell anything: we have not promised that kits will be offered, or when, or at what price. We may stop the waitlist at any time. If we do, we will tell you and erase your details. We will still follow this clause and our Privacy Policy, including your right to unsubscribe.
What the waitlist keeps. When you join we keep the email address you give us, and the other details you choose to give (name, state, solar and battery brand, number of homes), together with the time you agreed to be contacted. We use them to email you about the Home Kit and to see which equipment and home setups to support first, as described in the Privacy Policy at /privacy. We send a confirmation email with an unsubscribe link, and every waitlist email has one.
Leaving the waitlist. You can leave at any time, with no reason needed, using the unsubscribe link in any waitlist email or by emailing support@solar-split.com. When you leave we erase the details you gave us and keep only what is needed to make sure we never email that address about the waitlist again.
When kits go on sale. The terms for buying a kit (price, delivery, returns and warranty) will be published here before any kit is sold, and you will not be asked to pay until you have seen them.
Your Australian Consumer Law rights. Nothing in this section excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law.
8. Electrical safety
The Home Kit hub needs no electrical work: it connects to your home network only. Meters are different. Installing a meter is electrical work for your own licensed electrician, and Solar Split does not install them.
Do not open a switchboard, work on wiring, or install clamp meters, current transformers or other metering equipment yourself unless you are a licensed electrician. Electrical work is regulated in Queensland and other states, and doing it unlicensed can be illegal and dangerous. If you want sub-metering hardware, engage a licensed electrician.
9. Third-party services
Solar Split reads data through services run by inverter, battery and meter vendors, and it uses providers such as Stripe and Microsoft. Their own terms apply to their services.
We are not responsible for a vendor's outage, data errors, quota limits, policy change, or decision to end or restrict access. If a vendor connection stops working, your figures may be incomplete until it is restored. Some vendor connections need you to renew access, such as a token that expires. We will remind you where we can.
You must have the right to give us access to any account or equipment you connect.
10. Acceptable use
You agree not to:
- use Solar Split unlawfully, or to mislead or overcharge anyone;
- connect equipment or accounts you are not authorised to use;
- try to break, probe or overload the service, or access another customer's data;
- copy, resell or reverse engineer the service, except as the law allows;
- use it to control or interfere with electrical equipment.
We may suspend or end accounts that break these rules, after warning you where practical.
11. Accuracy
We work hard to make the calculations correct and repeatable. But results depend on data and settings supplied by you and third parties, and on tariff information that changes. Treat every figure as an estimate and check it before you rely on it or charge anyone.
This does not limit your rights under the Australian Consumer Law, and we do not claim that results are exact.
12. Limits on our liability
Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or other law that cannot be excluded, including consumer guarantees.
Subject to that, and to the extent the law allows:
- we are not liable for indirect or consequential loss, loss of profit, or loss from decisions you make based on Solar Split's figures;
- where our liability for a failure of a service or goods cannot be excluded and the law lets us limit it, our liability is limited to resupplying the service or goods, or paying the cost of doing so;
- otherwise, our total liability to you for a claim is limited to the amount you paid us in the 12 months before the claim.
13. Your data
How we handle personal information is set out in the Privacy Policy at /privacy. You keep ownership of your data. You give us permission to use it to run Solar Split for you.
14. Changes to these terms or the service
We may change these terms or the service. For material changes we will give you at least 30 days' notice by email. If you do not agree, you can cancel before the change starts. We do not change price or key terms during a paid period without notice.
15. Governing law
These terms are governed by the laws of Queensland, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Queensland. This does not limit any right you have to bring a claim elsewhere under the Australian Consumer Law.
